TERMS AND CONDITIONS
The following terms and conditions apply to 104.7’s promotion “Clubman Mini Escapes”
These terms and conditions apply in conjunction with 104.7’s General Terms and Conditions. Where there is any inconsistency, these terms and conditions will prevail.
Both these terms and conditions and the 104.7 General Terms and Conditions can be collected at the 104.7 reception desk at Bellenden Street, Gungahlin and can be downloaded from the website at www.1047.com.au.
1. DURATION
The Contest will run from Monday 21 April – Monday 19 May, 2008, and from Monday 9 June – Monday 7 July, 2008. The prize draws will take place on Monday 5 May, 2008, Monday 19 May, 2008, Monday 23 June, 2008 and Monday 7 July, 2008.
2. METHOD OF ENTRY
Canberra’s Hit Music Station 104.7 will be giving listeners the chance to win Clubman Mini Escapes over an eight week promotional period. Listeners will be encouraged to SMS the word ‘Clubman’ to 1990 1047 (premium SMS 55 cents) to go into the draw to win one of four Clubman Mini Escapes to either the coast or the snow.
Contesting will be split over two four week periods, with the first four weeks focusing on the Clubman Mini Escapes to the Coast, and the second four week period focusing on the Clubman Mini Escapes to the snow.
Rolfe Classic and 104.7 will alternate weeks driving the Mini Clubman around Canberra.
Entry is open to Australian Capital Territory residents and residents of NSW within an 80km radius.
3. PRIZE(s)
Coast Mini Escapes:
2 x Coast Mini Escapes consisting of:
· 1 nights accommodation for 2 people at the Esplanade Motor Inn Batemans Bay, including buffet breakfast. Accommodation is subject to availability and is valid until December 2008.
· Use of a MINI Vehicle for 2 nights. Vehicle will be a MINI Clubman where possible, otherwise a MINI Hatch or Cabrio will be substituted. Driver must have a current full drivers licence and sign an indemnity contract. Vehicle will be supplied with a full tank of petrol. Any additional petrol required during the drive will be the responsibility of the prize winner.
· 1 Gift Basket including 2 x MINI T-Shirts, 2 x MINI caps, 1 x MINI chocolates, 1 x Champagne
Value of each Coast Mini Escape: $450.00
Snow Mini Escapes:
2 x Snow Mini Escapes consisting of:
· 1 nights accommodation for 2 at Thredbo Alpine Village, including buffet breakfast, 2 day adult lift passes and lessons. Accommodation is subject to availability and is valid from June 30 – 4 July, and 21 July – October 2008.
· Use of a MINI Vehicle for 2 nights. Vehicle will be a MINI Clubman where possible, otherwise a MINI Hatch or Cabrio will be substituted. Driver must have a current full drivers licence and sign an indemnity contract. Vehicle will be supplied with a full tank of petrol. Any additional petrol required during the drive will be the responsibility of the prize winner.
· 1 Gift Basket including 2 x MINI T-Shirts, 2 x MINI caps, 1 x MINI chocolates, 1 x Champagne
Value of each Snow Mini Escape: $1, 964.00
Total value of all prizes: $4, 828.00
It is a condition of entry that 104.7 has the right to publicise the names, characters, likenesses or voices of any contestants for any promotion or matter incidental to the competition.
The winner may also be required by 104.7 to participate in a photo, video and/or film session and acknowledges that 104.7 has the right to use such publicity photos, videos and/or films in any medium (including, without limitation, the internet) and in any reasonable manner it sees fit, unless that person advises 104.7 at the time of entering the competition that he/she wishes to retain his/her anonymity.
Contestants also acknowledge that their photo may be used for a promotional display at the prize provider’s location.
Contestants consent to their telephone and other conversations with 104.7 being broadcast on air.
5. INDEMNITY
All contestants release Canberra FM Radio Pty Ltd (ACN 074 733 823) and it’s related entities from, and indemnify against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
6. NOTIFICATION
Winners of the major prizes will be notified by telephone at the time of winning and have their details published on www.1047.com.au.
7. COPYRIGHT
By entering this competition all entrants:
· consent to Canberra FM Radio Pty Ltd making copies of the whole or any part of their entry
· grant to Canberra FM Radio Pty Ltd all present and future copyright and all other rights in their entry in all media (including, without limitation, the internet) and whether in existence now or created in the future
· Undertake to Canberra FM Radio Pty Ltd that their entry is not in breach of any third party intellectual property rights.
8 All prizes are non transferable.
9. No person may win the contest more than once.
10. No person may win more than one prize. In the event that 104.7 becomes aware that the same person has been the successful winner through more than once that winner will be disqualified and another winner may be taken in their place. All decisions and actions of 104.7 staff will be exercised according to their absolute discretion.
11. The winner of the major prize will be contacted by reception at 104.7 once their prize is ready to collect & will be required to pick up their prize from 104.7.
12. Winners will be responsible for any and all taxes incurred in relation to their receipt of their prize(s). Winners should seek independent financial advice prior to accepting a prize.
13. Employees and their immediate families of 104.7 and Canberra FM Radio Pty Ltd are ineligible to enter. Employees and their immediate families of all associated sponsors and participating companies are also ineligible to enter.
14. If a winner is under the age of 18 years, 104.7 reserve the right to award the prize to their parent or legal guardian.
15. If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone failure, tampering, fraud or any other causes beyond the control of Canberra FM Radio Pty Ltd which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, 104.7 reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. 104.7 must refer to the ACT Gambling and Racing Commission prior to cancelling, terminating, modifying, or suspending the competition.
16. 104.7 and Canberra FM Radio Pty Ltd will not be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided. 104.7 may at its absolute discretion substitute a different prize in place of any prize referred to in these terms and conditions, after gaining relevant approval from relevant gaming authorities.
17. All winners of all prizes must sign these terms and conditions and the 104.7 General Terms and Conditions both in a form prescribed by Canberra FM Radio Pty Ltd in order to receive their prize. In the event that a prize winner under the age of 18 years is permitted to accept a prize, these terms and conditions and the 104.7 General Terms and Conditions must be signed by their parent or legal guardian.
18. 104.7 may, subject to State Regulations, terminate this competition at any time at its absolute discretion without liability to any contestant or other person. After gaining relevant approval from relevant gaming authorities.
19. In all matters, all decisions of 104.7 staff will be final and cannot be contested. No correspondence or discussions will be entertained.
20. Obtaining time off work and/or study or related activities to participate in this competition will be the sole and absolute responsibility of each contestant.
21. 104.7 reserve the right to exclude any persons from the competition on the ground of their medical condition or history or any reason whatsoever.
22. The personal information supplied by entrants when entering this competition will be used by 104.7 to conduct the competition, to contact entrants if they are a winner and in accordance with 104.7’s Privacy Policy. The information may also be included in database/s maintained by 104.7 used to let entrants know about special offers from 104.7 and new developments. Please refer to our Privacy Policy for more information as entry in this contest is an agreement to be bound by that policy. Our current Privacy Policy is available at www.1047.com.au or from 104.7 reception. Any entrants may have their details removed from 104.7 database/s at any time by simply contacting 104.7 on 02 6123 4104 or via www.1047.com.au. If details are removed prior to the conclusion of the competition and/or award of prize(s), entrants will forfeit their right to claim any prizes.
23. PROMOTER
The promoter is Canberra FM Radio Pty Ltd trading as 104.7 of Bellenden Street, Gungahlin ACT 2912. ABN number 35 485 579 727.
24. UNCLAIMED PRIZE DRAW
An unclaimed prize draw will take place on October 7, 2008. This draw will take place at 104.7 Studios, Bellenden Street, Gungahlin ACT.
